Elon Musk loses OpenAI lawsuit as jury rules his claims came years too late
Elon Musk has officially lost his lawsuit against Sam Altman, Greg Brockman, OpenAI, and Microsoft after a California jury unanimously ruled that he filed his claims too late. Musk accused his former cofounders of betraying OpenAI’s original nonprofit mission and “stealing a charity,” but jurors found that any alleged harm occurred years before the legal deadline.
The trial revisited OpenAI’s turbulent early history and featured testimony from major Silicon Valley figures, but ultimately hinged on narrow procedural questions. Judge Yvonne Gonzalez Rogers said the evidence strongly supported the verdict.
With the case now closed, OpenAI avoids the possibility of a forced restructuring — a major relief as the company reportedly moves toward an IPO.
